Welcome to djAI! These Terms of Service ("Terms") govern your access to and use of the djAI application, website, and services (collectively, the "Service") provided by C&P Apps Michael Knochen Einzelunternehmen ("we", "us", or "our"). Please read these Terms carefully.
By accessing or using the Service, in particular by creating an account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
djAI is a web-based service that enables users to generate pieces of music using artificial intelligence (AI). Users can provide text inputs ("prompts") and parameters such as genre, mood, and style to create unique audio and image files (collectively, "generated content").
3.1. To use the Service, you must create an account. You must provide accurate and complete information and keep it up to date.
3.2. You are solely responsible for the security of your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3. You must be at least 16 years old to use the Service.
4.1. Creating generated content requires "song credits". Song credits can be purchased in packages through our Service. Current prices are displayed on the website.
4.2. Purchased song credits are non-refundable and non-transferable. They have no monetary value outside the Service and may only be used to generate content within the Service.
4.3. All payments are processed through our external payment provider (Stripe). Its terms of use and privacy policy apply.
5.1. Our Service: All rights in the Service itself, including the software, design, text, graphics, and our logo, remain with us or our licensors.
5.2. Your Inputs (Prompts): You retain all rights to the text and ideas you enter. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your inputs solely for the purpose of providing and improving the Service (i.e., generating your songs).
5.3. Generated Content (Songs & Artwork): Subject to your compliance with these Terms, we grant you a non-exclusive, royalty-free license to use, reproduce, and play back your generated content solely for private, non-commercial purposes (e.g., personal listening or private sharing with friends and family).
5.3.1. No Commercial Use, No Distribution on Platforms: Any commercial use of generated content is excluded. In particular, you may not:
5.3.2. IMPORTANT: Because the content is AI-generated, we cannot guarantee that it is unique or free of third-party rights that may have been present in the AI's training data. Use of the generated content is at your own risk. You are responsible for determining whether the generated content is suitable for your specific purpose and does not infringe the rights of third parties.
5.4. Copyright Status of AI Works: The legal position regarding copyright protection for purely AI-generated works has not yet been conclusively settled in many jurisdictions. We therefore cannot guarantee that the content you generate is eligible for copyright protection.
You agree not to use the Service to:
7.1. The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
7.2. We assume no liability for the quality, accuracy, or legality of the generated content. Use of the AI and the resulting content is at your own risk.
7.3. Our liability for damages arising from use of the Service is limited to intent and gross negligence. This limitation does not apply to damages resulting from injury to life, body, or health.
We may amend these Terms from time to time. If we make material changes, we will notify you via a notice on our website or by email. Your continued use of the Service after such changes take effect constitutes your acceptance of the new Terms.
You may delete your account at any time. We may likewise suspend or terminate your access to the Service at any time and for any reason, in particular in the event of a breach of these Terms.
These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Gera, Germany.
Should any provision of these Terms be or become invalid or unenforceable, the remaining provisions shall remain unaffected and in full force and effect.
